1. Scope of Application, Customer Group & Small Business Status

1.1 These General Terms and Conditions (GTC) apply to all contracts for the delivery of goods and services concluded between Lukas Vidrago Nell, operating under the business name VIDRAGOLD (hereinafter referred to as the “Provider”), and the customer.

1.2 The offer is directed at consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

An entrepreneur is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.

1.3 Notice regarding tax status: As a small business within the meaning of Section 19 of the German Value Added Tax Act (UStG), no value-added tax is charged or shown separately. All stated prices are total prices.

2. Contracting Party, Conclusion of Contract & Ordering Methods

The purchase contract is concluded with:

Lukas Vidrago Nell (VIDRAGOLD)

The conclusion of the contract differs depending on the ordering method:

2.1 Orders via the Online Shop (Catalogue Designs)

2.1.1 By placing the products in the online shop, the Provider makes a binding offer to conclude a contract for these items.

2.1.2 The customer may initially place products in the shopping cart without obligation and may correct their entries at any time before submitting the binding order.

2.1.3 The contract is concluded when the customer accepts the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, the customer receives a confirmation by email.

2.2 Inquiries & Custom Orders (Custom-Made Products via Contact Form/Email)

2.2.1 Customer inquiries submitted via the contact form or by email for individual custom-made products are non-binding.

2.2.2 The Provider will then prepare an individual offer in text form (e.g. by email / PDF quotation), including the specifications and prices.

2.2.3 The contract is concluded as soon as the customer expressly confirms this offer in text form (by email).

3. Customer Cooperation & Design Approval for Custom Orders

3.1 For individual custom-made products, the customer is obliged to carefully review all specifications, dimensions, ring sizes, and 3D CAD designs / graphics provided by the Provider before granting production approval.

3.2 The production process will only begin after the customer has expressly approved the design and the agreed payment/down payment has been received.

3.3 The Provider assumes no liability for errors resulting from incorrectly transmitted customer data (e.g. an incorrect ring size) or designs approved prematurely.

3.4 Minor deviations in terms of colour shade, inclusions in gemstones, or subtle nuances may occur due to natural characteristics and handcrafted production and do not constitute a defect.

4. Production and Delivery Times, Shipping Conditions

4.1 No Stock Items: All items are manufactured by hand or according to the customer's order after receipt of the order.

4.2 Production Times:

Catalogue Orders (Online Shop): The production and delivery time is approximately 2 to 4 weeks.

Custom Orders: The production and delivery time is approximately 6 to 8 weeks from final design approval and receipt of payment (depending on the complexity of the order).

4.3 In the case of payment in advance / bank transfer, the delivery period begins on the day following the day on which the payment order is issued to the transferring credit institution.

4.4 Shipping within Germany is free of charge. For deliveries to selected countries outside Germany, shipping costs apply and will be stated before the conclusion of the contract.

5. Delivery Method

Delivery is made exclusively by shipping. Collection in person or delivery to parcel stations is not possible.

5.1 Payment & Payment Methods

Depending on the selected ordering method, the following payment methods are available:

5.1.1 Bank Transfer (Payment in Advance / Standard for Custom Orders):

The customer transfers the invoice amount to the specified bank account after conclusion of the contract. The production process begins after receipt of the amount.

5.1.2 Shopify Payments / PayPal (Standard in the Online Shop):

PayPal: The invoice amount is processed through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A. The payment transaction is carried out by PayPal immediately after confirmation of the payment instruction.

6. Right of Withdrawal & Exclusion for Custom-Made Products

6.1 Consumers generally have a statutory 14-day right of withdrawal for distance contracts.

6.2 Statutory exclusion of the right of withdrawal (Section 312g (2) No. 1 BGB):

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the consumer's personal needs (e.g. custom designs, products made to individual customer measurements, engravings, or specific gemstone combinations).

7. Copyright in Designs

All copyrights, design rights, and rights of use relating to sketches, 3D CAD models, visualisations, and jewellery designs created by the Provider shall remain fully with the Provider (Lukas Vidrago Nell / VIDRAGOLD), unless expressly agreed otherwise.

8. Retention of Title

The goods remain the property of the Provider until full payment has been received.

9. Warranty (Liability for Defects)

9.1 The statutory provisions governing liability for defects shall apply.

9.2 Normal signs of wear resulting from wearing the jewellery, as well as damage caused by improper handling, are excluded from the warranty.

10. Contract Language & Storage of Contract Text

10.1 The language available for the conclusion of the contract is German.

10.2 The Provider stores the contract text and sends the customer the order details and the GTC in text form.

11. Dispute Resolution

The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The possibility of alternative dispute resolution remains unaffected by this.
